Position Overview:

Our client, a respected plaintiff-side law firm with a growing Nursing Home Litigation practice, is seeking an experienced Litigation Attorney to join its team. This is an excellent opportunity for an attorney who is passionate about advocating for elderly and vulnerable individuals who have suffered serious injuries as a result of negligent or inadequate care.

The attorney will handle a caseload of plaintiff-side nursing home negligence and elder abuse matters and will have significant responsibility for cases from initial investigation through settlement or trial. The ideal candidate will bring strong litigation skills, sound judgment, excellent legal writing and advocacy abilities, and the ability to work effectively with clients, families, experts, and litigation professionals.

This opportunity is particularly well suited to an attorney with experience in nursing home negligence, elder abuse, medical malpractice, personal injury, or other complex plaintiff-side litigation who is looking to take greater ownership of cases and contribute to the continued growth of a specialized litigation practice.

About the Client:

Our client is an established plaintiff-side litigation practice focused on representing individuals and families in complex cases involving serious injuries and negligent care. The firm is committed to providing dedicated, compassionate representation to clients while pursuing strong outcomes through strategic litigation, negotiation, mediation, and trial advocacy.

The firm's Nursing Home Litigation practice represents elderly and vulnerable individuals who have suffered harm due to failures in care, supervision, staffing, medication management, nutrition, infection control, and other aspects of nursing home and healthcare services.

Key Responsibilities:

  • Manage a caseload of plaintiff-side nursing home negligence and elder abuse matters from inception through resolution.

  • Investigate and develop claims involving pressure injuries/bedsores, falls, fractures, infections, malnutrition, dehydration, medication errors, elopement, inadequate supervision, and other failures of care.

  • Draft and review pleadings, complaints, bills of particulars, discovery demands and responses, motions, affirmations, and other litigation documents.

  • Conduct and defend depositions involving plaintiffs, defendants, nursing home personnel, healthcare providers, experts, and other witnesses.

  • Review, organize, and analyze nursing home charts, hospital records, medical records, policies and procedures, incident reports, and other relevant evidence.

  • Work closely with medical, nursing, and other experts to evaluate liability, causation, and damages.

  • Develop case strategy and identify critical liability and damages issues.

  • Conduct legal research and prepare substantive motions, oppositions, and other written advocacy.

  • Attend court conferences, hearings, mediations, settlement conferences, and other proceedings.

  • Negotiate settlements with defense counsel, insurance representatives, and other parties.

  • Prepare cases for trial, including witnesses, experts, exhibits, medical evidence, and motions in limine.

  • Maintain regular and professional communication with clients and their families throughout the litigation process.

  • Collaborate with paralegals and other members of the litigation team to ensure cases progress efficiently and all deadlines are satisfied.

Qualifications:

Required

  • Admission to the New York State Bar and in good standing.

  • Strong understanding of New York civil litigation practice and procedure.

  • Demonstrated litigation experience, including experience managing cases and meeting court and discovery deadlines.

  • Experience taking and/or defending depositions.

  • Excellent legal research, writing, negotiation, and oral advocacy skills.

  • Ability to analyze complex medical records and evidence.

  • Strong organizational and case-management skills.

  • Excellent client communication and interpersonal skills.

Preferred:

  • 3+ years of litigation experience.

  • Plaintiff-side experience involving nursing home negligence, elder abuse, medical malpractice, personal injury, or other complex litigation.

  • Experience working with medical, nursing, and other expert witnesses.

  • Experience handling cases through settlement and/or trial preparation.
